By purchasing an Syxth device or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Service

Syxth provides a wearable device with integrated camera and audio capabilities, along with cloud-based AI processing services. The service includes:

  • Hardware: A wristband device with integrated camera, capture button, electronics, and haptic feedback, plus an earpiece
  • Cloud Processing: Image analysis, AI reasoning, and text-to-speech synthesis
  • Customer Portal: Web-based account and device management

3. Account Registration

To use our services, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree NOT to use our services to:

  • Violate any applicable laws or regulations
  • Infringe on others' privacy, intellectual property, or other rights
  • Capture images without consent where legally required
  • Engage in academic dishonesty, fraud, or deception
  • Circumvent security measures or rate limits
  • Reverse engineer, decompile, or disassemble the device or services
  • Resell or redistribute the service without authorization
  • Use the service for any illegal purpose
Important: You are solely responsible for ensuring your use of this device complies with all applicable laws in your jurisdiction, including privacy laws, recording consent requirements, and academic integrity policies. We do not encourage or condone illegal use.

5. Subscription and Payment

5.1 Subscription Tiers

Cloud services are provided through subscription tiers with varying daily request limits. Pricing and features are as displayed on our website and may change with notice.

5.2 Free Tier

The free tier provides limited requests per day at no cost. It may be modified or discontinued at our discretion.

5.3 Trial Period

Hardware purchases include a trial period of the Heavy tier. After the trial, you may continue on any tier including free.

5.4 Payment

We accept major payment methods. All payments are final. We do not offer refunds for subscription payments.

5.5 Price Changes

We reserve the right to change subscription pricing with 30 days notice. Existing subscriptions will honor the price at the time of purchase until renewal.

6. Hardware Purchase

6.1 Orders

Orders are placed through our website. Order details, subscription tier, and shipping information must be confirmed before payment.

6.2 Payment

Full payment is required before manufacturing begins.

6.3 No Refunds

Every unit is built to order at small scale. Because of this, we do not offer refunds on hardware purchases. If you receive a defective unit, see our warranty policy below.

6.4 Shipping

We ship to most countries. Shipping times and methods vary. You are responsible for any import duties or taxes.

6.5 Warranty

Hardware is covered by a 60-day warranty against manufacturing defects. Warranty does not cover:

  • Damage from misuse, accidents, or modifications
  • Normal wear and tear
  • Water damage beyond rated specifications
  • Damage from unauthorized repairs

7. Intellectual Property

All intellectual property in the device, firmware, services, and documentation remains our property. You receive a limited license to use the device and services for personal purposes only.

You may not:

  • Copy, modify, or create derivative works from our software
  • Reverse engineer the device or firmware
  • Remove or alter any proprietary notices
  • Use our trademarks without permission

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The service may be unavailable due to:

  • Scheduled maintenance (we will attempt to provide notice)
  • Unplanned outages or technical issues
  • Third-party service disruptions
  • Force majeure events

9. Service Discontinuation

If we permanently discontinue the hosted cloud service, we will:

  • Provide at least 90 days notice to active users
  • Release a final firmware update enabling self-hosted operation
  • Provide documentation for connecting to third-party services

Self-hosted mode may have different features and performance than the hosted service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI RESPONSES

We do not warrant that AI responses will be accurate, complete, or suitable for any purpose. You should not rely on AI responses for critical decisions without independent verification.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your use or inability to use the service
  • Damages arising from AI response inaccuracies
  • Actions taken based on AI responses

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Content you capture or process through the service

13. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in abusive or fraudulent behavior
  • Fail to pay subscription fees

You may terminate your account at any time through the customer portal or by contacting us. No refunds will be provided for unused subscription time.

14. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

16. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by email or through the service. Continued use after changes constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
